1. Acceptance of terms

These terms of use (the "Terms") constitute a contract between you (the "User") and CAP2B Inc. ("CAP2B", "we", "our", or "us") and govern your access to and use of any site, platform, client portal, CRM, or digital tool operated by CAP2B (the "Website"), including any content, information, product, or service offered on it.

By accessing the Website, you agree to be bound by the Terms then in effect and confirm that you have the legal capacity to enter into such a contract, on your own behalf or on behalf of any legal entity you represent. You declare that you are at least 18 years old (or have reached the age of majority in your province or territory of residence). If you do not accept these Terms, you are not authorized to use the Website.

2. Intellectual property

All content displayed or made accessible through our Website — including without limitation: text, visuals, files, interfaces, databases, source code, web applications, digital tools, elements generated by artificial intelligence (the "AI Tools" and "AI Content"), trademarks, trade names, or logos — (collectively the "Content") is protected by Canadian and international intellectual property laws.

Unless otherwise indicated, CAP2B retains all rights, title, and interest in the Content. No ownership rights are transferred to the User by virtue of accessing or using the Website.

3. Limited license

CAP2B grants the User a personal, non-exclusive, non-transferable, and revocable license to access the Website and use its features for internal, personal, and non-commercial purposes, in compliance with these Terms.

Any other use, in particular commercial, automated, systematic, or mass use (scraping, duplication, republication, transmission, etc.), is strictly prohibited without CAP2B's prior written consent.

4. Artificial intelligence tools

The Website may include tools powered by artificial intelligence technologies developed or integrated by CAP2B. AI Content generated through these tools is provided for informational purposes only and without any warranty of reliability, accuracy, or suitability for regulatory or professional standards.

The User is solely responsible for verifying AI Content before any use, and CAP2B disclaims all liability for the consequences of its use.

5. Prohibited conduct

You agree not to:

  • misappropriate or copy the Content for commercial purposes;
  • disrupt or compromise the security, integrity, or operation of the Website;
  • access without authorization any data, system, or infrastructure of CAP2B;
  • publish, transmit, or share unlawful, defamatory, offensive content, or content that infringes the rights of others, through our forms, interfaces, or interactive modules;
  • attempt to collect the personal data of other users without consent;
  • use our services for fraudulent purposes, spam, or unauthorized mass distribution.

CAP2B reserves the right to suspend access to its services without notice in the event of a breach of these Terms.

CAP2B Inc. text message (SMS) program: by checking the corresponding box on our contact form, you opt in to CAP2B's customer-care text message program and consent to CAP2B collecting and using your personal data (phone number, email address) to send you service messages, in accordance with the choices you have expressed. This SMS program is strictly limited to customer care and sends no promotional messages. Text messages are sent only to individuals who voluntarily submit our form; CAP2B does not send any SMS to purchased contacts, third-party lists, or leads generated on behalf of third parties. This consent is optional and is not a condition of purchase.

Service messages (SMS and email): You agree to receive replies to your requests, confirmations, reminders, and appointment follow-ups concerning your requests to CAP2B. The frequency of these communications may vary as needed.

Promotional emails: If you consent separately, you agree to receive promotional offers, news, and marketing communications from CAP2B by email. No promotional text messages (SMS) are sent. Frequency may vary, and every email includes an unsubscribe link.

Message and data rates may apply depending on your mobile plan. These charges are billed by your mobile carrier and are beyond CAP2B's control. For any questions about these charges, please contact your mobile provider.

  • For text messages (unsubscribe): You can unsubscribe at any time by texting the word "STOP" to the number indicated in our messages.
  • For assistance: Text "HELP" or contact our customer service.
  • Email unsubscribe: You can also unsubscribe from email communications via the unsubscribe link in every message.

10. Contests and campaigns

Any contest or promotional campaign run by CAP2B through the Website is governed by separate rules accessible from the dedicated pages.

11. Limitation of liability

CAP2B makes every effort to ensure the accuracy and availability of its Website, but does not warrant that it will be free of errors, interruptions, or vulnerabilities.

The Terms are governed by the laws in force in the province of Quebec, Canada. Any dispute relating to the interpretation or application of these Terms that cannot be resolved amicably will be brought before the courts of the judicial district of the city of Trois-Rivières.

Mobile carriers are not liable for delayed or undelivered messages.

All other use categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
