Scope

This website (the "Site", cap2b.ca) is operated by CAP2B Inc. ("we", "our", "us"). CAP2B Inc. provides service businesses with lead generation and client acquisition solutions. We respect your right to privacy and protect your personal information in accordance with the laws applicable in Quebec and Canada, including the Act respecting the protection of personal information in the private sector (as amended by Law 25).

This policy governs the use of the Site and the processing of personal information. It applies to:

  • anyone who visits the Site (the "VISITORS");
  • any person or business that contacts us, notably through the Site's contact form, to obtain information about our services or to use them (the "CLIENTS").

1. Information collected

The personal information we collect from the CLIENT is limited to their contact details — namely their address, email address, and phone number (along with the associated name). The CLIENT may also choose to provide additional information within the content of their communications.

In addition, when you browse the Site, third-party audience-measurement and advertising tools (the Meta pixel by Facebook and Vercel Analytics) may automatically collect technical data, including IP address and cookie identifiers, for audience-measurement and advertising purposes (see section 9).

2. Purposes of use

This information is used in order to:

  • respond to the CLIENT's requests and communicate with them;
  • prepare a service proposal or quote;
  • provide our services and manage the business relationship;
  • handle billing and contractual follow-up;
  • measure Site audience and improve how it works.

3. Sharing of information

We do not sell your personal information. We use service providers (hosting, customer relationship management, communication, audience-measurement and advertising tools) that act on our behalf and are bound by confidentiality commitments.

No information is disclosed to any other third party without the CLIENT's prior consent, except where required by law.

4. Consent

By providing their information, notably by completing the contact form, the CLIENT consents to being contacted by us using the contact details provided (phone, email, or any other reasonable means), as part of following up on their request or any matter reasonably related to it. This consent is given in a clear, free, and informed manner, and may be withdrawn at any time (see section 7).

If the information provided is inaccurate, incomplete, or misleading, or if we have reasonable grounds to believe so, we may decline to act on the request, without incurring any liability.

5. Security

Reasonable administrative, technical, and organizational measures (including access control, encryption, and backups) are in place to ensure the security and confidentiality of personal information.

6. Retention

Personal information is kept only for as long as necessary to fulfill the purposes for which it was collected, or to meet our legal obligations, then securely destroyed or anonymized, notably:

  • when the business relationship has ended and applicable obligations have been met; or
  • when the CLIENT so requests.

7. Your rights

Subject to the conditions and limits provided by law, you have the right to:

  • access the personal information we hold about you;
  • have it corrected or updated;
  • withdraw your consent to its collection, use, or sharing;
  • request the deletion or cessation of dissemination of your information (de-indexing), within legal limits;
  • portability: receive, in a structured, commonly used technological format, the computerized information you have provided to us, or request its transfer to a third party where technically feasible.

To exercise these rights, contact the person in charge of the protection of personal information (section 11). You may also file a complaint with the Commission d'accès à l'information du Québec.

8. Hosting and communication outside Quebec

The Site is hosted by our cloud infrastructure provider. Some data may be processed by service providers located in the United States (notably hosting, audience measurement, and customer relationship management). These communications outside Quebec are subject to a privacy impact assessment and are governed by contractual agreements intended to ensure adequate protection of the information.

9. Cookies and tracking technologies

The Site uses third-party audience-measurement and advertising tools, namely the Meta pixel by Facebook and Vercel Analytics. These tools may set cookies and collect technical data, including IP address and identifiers, for audience-measurement and advertising purposes.

Cookies strictly necessary for the Site to function are set without consent. You can configure your browser to block non-essential cookies or to be notified of them.

10. Changes

We reserve the right to modify this policy, in whole or in part, at any time. Any change takes effect upon publication on the Site. Where required by law, reasonable notice is given before changes take effect.

11. Person in charge of the protection of personal information

The person in charge of the protection of personal information, responsible for ensuring compliance with this policy and handling your requests, can be reached at:

12. Privacy incidents

In the event of a privacy incident, we take reasonable measures to reduce its consequences and prevent recurrence, and we maintain a register of incidents. When an incident presents a risk of serious harm, we notify the Commission d'accès à l'information and the individuals concerned, in accordance with the law.

13. Minors

The Site is intended for businesses and professionals; it is not directed at minors and we do not knowingly collect their information.

14. Text message (SMS) communications

When you provide your mobile phone number and check the corresponding consent box on our contact form, you opt in to CAP2B Inc.'s customer-care SMS program. This consent is optional and is not a condition of obtaining our products or services.

Our SMS program is strictly limited to customer care. Text messages are limited to communications related to a request you have submitted, including:

  • replies to your information or support requests;
  • appointment coordination, confirmations, and reminders;
  • follow-ups related to your request or file.

No promotional or marketing text messages are sent under this program. Text messages are sent only to individuals who voluntarily submit our contact form regarding CAP2B's services. CAP2B does not send text messages to purchased contacts, third-party lists, or leads generated on behalf of third parties.

Message frequency may vary. Message and data rates may apply depending on your mobile plan; these charges are billed by your carrier and are beyond our control. You can unsubscribe at any time by replying STOP to any of our text messages, or get help by replying HELP. Promotional communications, if any, are sent by email only and include an unsubscribe link in every message.

15. Mobile information privacy (SMS)

No mobile information — including your phone number and your text-message consent and opt-in data — will be sold or shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors strictly necessary to provide the service (for example, our SMS delivery platform) is limited to that purpose only. Text messaging originator opt-in data and consent will not be shared with any third parties.
